AND THEIR UNITS CARRYING OUT SUPERVISION OF COMPLIANCE WITH INTERNATIONAL LAW

Who can apply?

Anyone can submit a complaint to the Committee against the State:
 

  • Who is a party to the treaty in question (by ratification or accession) that provides for the rights that are allegedly violated;

  • Recognized the competence of the Committee to consider individual complaints either by ratifying or acceding to the Optional Protocol (in the case of the ICCPR, CEDAW, CRPD, ICESCR and CRC), or by declaring to this effect in accordance with a specific article of the Convention (in the case of CERD, CAT, CRC and KTV).
     

Complaints can also be filed by third parties on behalf of individuals, provided that they have given their written consent (without requiring a specific form). In some cases, a third party may initiate proceedings without such consent, for example, when a person is in prison with no access to the outside world or is a victim of an enforced disappearance. In such cases, the complainant should clearly state why such consent cannot be given.
